You may be confused on the differences between Social Security Disability Insurance (“SSDI”) and Social Security Income (“SSI”). SSDI benefits are available for those who have a solid work history and have paid into the Social Security system earning enough credits. A person covered under SSDI has essentially paid through payroll tax withholdings to be considered as insured under Social Security. SSI is available to disabled individuals who have not purchased enough credits and lack a solid work history.
You may not need an attorney to represent you. Your disability may be so obvious that your application will be granted without input from an attorney. But, if you apply for social security and you are turned down, then you will probably want to consult an attorney to help you prepare your case for reconsideration and/or for an administrative hearing before a Social Security Judge (an Administrative Law Judge or “ALJ”).
